Basic Information on Getting a Company Builders Licence in ACT

Partnerships or corporations that give or advertise licensable 

construction services need an ACT company builders licence. Examples of licensable construction services are: 

  • Building Surveyors
  • Builders
  • Electricians
  • Drainers
  • Gasfitters
  • Work assessors 
  • Plumbers
  • Plumbing plan certifiers

Other types of businesses like trusts are not qualified to be licensed. They also cannot render work that needs a licence. 


Eligibility Requirements for Company Construction Licence in ACT


1. At least one or more appointed nominee


Partnerships and corporations should have a minimum of 1 nominee that has the following qualifications: 

  • An individual holding a licence to undertake construction jobs in the ACT. 
  • Should have sufficient capability to manage the construction service authorised under that licence. 
  • The agreement to be appointed as the nominee is documented in writing. The services that the nominee will be responsible for should be specified. They cannot exercise functions outside the agreement or those that they are not licensed to do. 
  • The nominee of a corporation must be a current employee or director of the company for which they will be appointed.
  • The nominee of a partnership should be a partner or a nominee of a corporation that is a partner in the partnership. 
  • Companies that have more than one nominee must document the services each nominee is responsible for. The nominees must always be capable of supervising all services to be given. 

A person automatically ceases to be a nominee once they are no longer eligible or a disciplinary action leads to disqualification. The construction occupation licensee must inform the Construction Occupations Registrar in writing within two weeks. 


2. Supporting documentation


  2-1. Partnerships must give proof of the existing partnership. 

  2-2. Corporations must specify the partner’s ACN. 

       2-2-1. The current and historical company extract should be submitted if the corporation’s history is in the ASIC database. 

        2-2-2. Corporations that are less than three months old must submit their current company extract. This can be obtained from the ASIC website. 

        2-2-3. Corporations that have their employee as a nominee must submit a copy of the signed employment contract or agreement.

Timeline for processing Corporation and partnership licence ACT


Evaluation of applications takes at least four weeks from the date of submission. Assessment will take longer if the application is incomplete or more information is needed for verification. The request for information will be sent through email.
