How to Get Mutual Recognition ACT builders Licence

The new Commonwealth legislation establishes the framework for ACT builder's licence mutual recognition. With this measure, an individual can use his registration from another state or territory to work in the ACT. 

The Mutual Recognition Amendment Act 2021 took effect on 01 July 2021. It amended the Mutual Recognition Act 1992. Some significant changes include the provision of a new automatic mutual recognition (AMR) scheme. 


Who Can Apply for Mutual Recognition ACT?


  • Mutual recognition is available for the following licensed professionals:
  • Building surveyors
  • Builders
  • Gas appliance workers 
  • Drainers, plumbers, and gasfitters
  • Plumbing plan certifiers

Conditions and Endorsements


Conditions and endorsements may be imposed on the licence to make it equivalent in the ACT. A standard builder licence application is required for amendments to the licence given via mutual recognition. 


Automatic Mutual Recognition ACT Builders Licence


The AMR Scheme allows registered individuals to work in other states and territories without applying for another licence. In essence, the scheme gives workers bigger opportunities to work in several states and territories. All these are done while still protecting work standards, workers, consumers, and other matters. 

Just like the pre-existing mutual recognition scheme, AMR is only applicable to individuals. Companies and other legal entities are not included.

Who is Eligible for Automatic Mutual Recognition?


The AMR scheme is only effective for participating jurisdictions. The ACT, Northern Territory, NSW, and Victoria have adopted the amendments to date. Unless the other states or territories join, AMR will cover the relevant occupations between territories and states that adopted the scheme. 

Unfortunately, there are some occupations and activities in Victoria that were temporarily exempted from the scheme. This includes architects, labour hires, building practitioners, plumbers, land surveyors, and environmental auditors. 


Are There Exemptions to Automatic Mutual Recognition? 


The AMR scheme does not apply to an individual if:

  • The person was subjected to civil, criminal, or disciplinary proceedings in any state. 
  • A person’s registration needed to carry out work in another state or territory was cancelled or suspended due to disciplinary action. 
  • The person was denied registration in any state or territory for a job that covers the activity being applied for. 
  • The person failed to comply with a requirement needed for automatic mutual recognition.

The AMR scheme still involves certain checks. An applicant will not necessarily be able to automatically get tools in another state. For instance, notification requirements may be in place in the second State.

Applicants must submit all required documentation to support their intent for mutual recognition. This is important, especially for those with issues such as being insolvent, bankrupt, or subject to financial conditions.
